Can birth injuries be the bases for a medical malpractice case?

  • Oftentimes an injury may be related to something that the doctor did wrong or the doctor failed to do.
  • Sometimes a child can be caught and the shoulder is caught under the mother’s bones. If that is not relieved appropriately or properly, the child can develop what is called Erb’s Palsy.
  • There are techniques to relieve that problem and if the physician does not use those appropriate techniques, the baby is going to be injured.
  • Sometimes, the obstetrician isn’t acutely aware of what that monitor is showing and if that fetal distress is permitted to go on for a prolonged period of time, you can have that fetus or that child develop Cerebral Palsy.
