Who is responsible when a product causes an injury?

  • Product liability claims can be brought against the manufacturer, the distributor or the retailer.
  • The distributor can be held responsible if that product is manufactured under the name of the distributor, the distributor was involved somehow in the design of the product, or the distributor made certain claims on the product packaging.
  • Retailers often design their own product, order a product to be designed for their shoppers, and often put their own names on the product.
  • Once you put your name on it, you may own it, particularly if you change the design for your own particular needs.
