Environmental Law and the Government

The government regulates how people act related to the environment. For example, the government establishes and enforces the level of hazardous substances allowed in water, soil and in the air. It also determines whether or not permits for use of certain hazardous substances can be issued. Violation of these regulations may lead to litigation. Our firm has represented the New Jersey Department of Environmental Protection for over 10 years. We are proud of our service to the state. Some of the matters we have litigated for the state include:

  • In Re MTBE, NJDEP v Amerada Hess et al.
  • NJDEP v. Bayer Cropscience
  • NJDEP v ExxonMobil et al.
  • NJDEP v. Minnesota Mining and Manufacturing Company et al

Environmental Law and Individuals

Environmental law doesn’t always involve the government; it can involve disputes between private citizens. We are honored to serve the people of New Jersey who face private environmental litigation matters. If something happened on somebody else’s property that affects your property, you may have the right to sue. Each person has the responsibility to make sure that what happens on their property does not impact somebody else. Similarly, each person who owns property has the right to enjoy that property without being harmed or interfered with by somebody else. For example, if a hazardous substance spilled or leaked on somebody else’s property, migrated on to your property, and has caused damage or affected your ability to live at your home, we can help you enforce your rights and recover the damages to which you are entitled.

Legal Action for Individuals

If you discover some environmental damage on your property, the first thing you should do is notify the proper authorities immediately. Contact the United States Environmental Protection Agency or the State Department of Environmental Protection. They can help you to determine how serious the issue is and, if necessary, respond immediately to any health hazards that may exist. If you think you have health problems due to an environmental condition, the first thing you should do is contact a physician. A physician can help you get the healthcare that you need. Once the immediate health and/or environmental concerns are resolved, you should contact an attorney who can help you recover the damages incurred. It is important to act quickly in order to bring a lawsuit. The statute of limitations restricts when you may engage in litigation. An attorney can assess your situation, guide you through your legal options, and litigate a matter on your behalf.
