Mercedes Diego is a seasoned attorney with over 25 years of experience and is a partner at Cohn Lifland. Her practice primarily focuses on commercial litigation, in addition to residential and commercial real estate, foreclosure matters, and bankruptcy. Mercedes is committed to driving successful transactions and resolutions, be that through powerful negotiation or persuasive litigation in the courtroom. Bilingual, Mercedes represents both English and Spanish-speaking clients.
Litigation
Mercedes represents clients by prosecuting and defending claims for matters such as breach of contract to cases involving construction litigation, wage and hour cases, and beyond. She handles cases from the pre-litigation stage, hiring experts where appropriate who can provide expert reports which can sometimes be used to resolve cases earlier than they would otherwise, saving our clients time and money and the stress that comes with years of litigation. Mercedes also handles all aspects of litigation from complaint to discovery to conclusion.
Real Estate
Whether the client is a seasoned investor, first-time homebuyer, business looking to acquire space, or a property owner, Mercedes provides guidance and counsel from contract to closing, and even post-closing, taking an active role in every part of the transaction and updating the client along the way. From purchases to commercial leases, financing to re-financing, Mercedes works to take the stress out of the process and achieve desirable results.
Clients in Financial Distress
A core component of Mercedes’ practice revolves around assisting clients that are struggling financially, specifically dealing with real estate that may be in distress, clients who may be in active foreclosure, and in bankruptcy. These areas of law are often closely intertwined with divorce and business issues. Because Cohn Lifland is such a diverse firm, Mercedes and her colleagues are able to work closely together to address each client’s unique needs, all in-house.
Foreclosure
As a commercial litigator with a focus on real estate, Mercedes represents individuals, businesses, and financial institutions in foreclosure matters. She handles all aspects of foreclosure proceedings from initiation and appointment of receivers to modification negotiations and supervision of auctions to any bankruptcy issues that may arise.
Bankruptcy
Mercedes’ bankruptcy clients range from individuals and couples to sole proprietors and businesses. Mercedes assists these clients with filing Chapters 7, 11, and 13, and the transactions associated with them, including debt management, debt negotiations, loan modifications, short sales, and foreclosure defense.
