Under New Jersey state law, employees must be paid for all hours worked. While federal law is a little more restrictive, employees are still entitled to be paid for all time spent on activities that are integral and indispensable to the job.
The bottom line is that an employee who is required to perform work “off the clock” is probably owed compensation for the time spent performing that work, even if the work is done before or after the scheduled shift.
Employers are required to keep accurate records of hours worked. Because of this, an employee can still have a claim for work performed “off the clock” even if the employer has not fulfilled its obligation to keep accurate records of hours worked.
